Welcome to Broller ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your access to and use of Broller's website, products, and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.
1. Acceptance of Terms
By creating an account or using any part of Broller, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and possess the legal authority to enter into a binding contract. If you use our Services on behalf of an entity, you agree to these Terms on behalf of that entity and represent that you have the authority to do so.
2. Description of Services
Broller is a web-based script-to-video editing platform. Our platform enables users to enter text-based scripts, segment them into storyboard scenes, search and curate premium stock video footage assets, compile timelines, generate automated text-to-speech voiceovers, and export finalized video compositions (collectively, "Output").
We continuously update and optimize Broller. We reserve the right to modify, suspend, or discontinue any feature or part of our Services at any time without prior notice.
3. Accounts and Security
To access certain features of Broller, you must register for an account using a valid email address. Authentication is handled securely. You are responsible for safeguarding your credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or breach of security.
4. Subscription Billing, Credits, and Payment Processing
Broller offers free trial plans and paid premium subscription tiers (such as Creator Pro and Pro Creator).
- Merchant of Record: Our order process and billing transactions are conducted by our secure third-party Merchant of Record (MoR) and payment processing partners. Our partners handle customer service inquiries, billing transactions, subscription renewals, tax calculations, and returns. By purchasing a subscription, you agree to our payment processor's checkout terms.
- Tokens and Video Minutes: Premium subscriptions provide monthly token allowances (e.g. 120 minutes/month for Creator, 400 minutes/month for Pro Creator). Video minute tokens are consumed when finalized videos are generated. Previews do not consume tokens. Unused monthly tokens do not carry over to subsequent billing cycles.
- Cancellation: You can cancel your subscription at any time through your account billing panel. Upon cancellation, your subscription remains active until the end of the current billing cycle.
5. Content Ownership and Licensing
Your Input
You retain all ownership rights to the narrative text, scripts, and original content you upload or input to the Services ("Input"). You grant Broller a worldwide, non-exclusive, royalty-free license to host, process, and compile your Input solely to generate the requested video storyboard Output.
Generated Output
Subject to your compliance with these Terms and payment of all applicable subscription fees:
- Starter / Free Tier: Outputs generated on the Starter plan are for personal, non-commercial use only and contain visual watermarks.
- Premium Tiers (Creator / Pro Creator): Outputs generated on premium tiers are watermark-free. Creator plans are for personal and channel-specific content. Pro Creator plans include a full commercial usage license to use, publish, distribute, and monetize generated videos across commercial channels, client projects, and advertising.
6. Prohibited Activities
You agree not to use Broller for any illegal, harmful, or unauthorized purposes. Specifically, you agree not to generate content that:
- Is defamatory, obscene, harassing, hateful, threatening, or discriminatory.
- Infringes on the intellectual property, copyright, trademark, or privacy rights of any third party.
- Spreads malicious misinformation, promotes violence, or violates child protection laws.
- Bypasses security measures, introduces malware, or attempts to reverse engineer the video rendering engine.
7. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. BROLLER DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE GENERATED OUTPUT WILL ACCURATELY DEPICT THE SCRIPT MEANINGS OR BE ERROR-FREE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BROLLER AND ITS PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
